Activa provides B2B cold email marketing and go-to-market execution services, including but not limited to list building, copywriting, inbox setup, domain configuration, campaign launch, optimization, and reporting.

3. Payments & Billing

  • All setup fees are one-time and non-refundable unless otherwise stated in writing.

  • Monthly retainers are billed in advance and due based on agreed terms.

  • Late payments may result in paused campaigns and withheld deliverables.

  • No performance guarantees are offered unless explicitly stated in a signed agreement.

4. Intellectual Property

All assets created by Activa (email copy, strategy docs, targeting frameworks, etc.) remain our intellectual property unless stated otherwise in writing. Clients receive usage rights during active engagement.

5. Acceptable Use

You agree not to use our services for:

  • Illegal or fraudulent activity

  • Promoting harmful, offensive, or discriminatory content

  • Email scraping, spamming, or violating email laws (e.g., CAN-SPAM, GDPR)

We reserve the right to terminate services for violations of the above without refund.

6. Disclaimer of Warranties

Activa does not guarantee results such as booked meetings, revenue growth, or reply rates unless specifically agreed to in writing. Our services are provided “as-is.”

7. Limitation of Liability

In no event shall Activa be liable for:

  • Indirect, incidental, or consequential damages

  • Lost profits or data

  • Service interruptions beyond our control (e.g., platform downtime, deliverability fluctuations)

Our maximum liability is limited to fees paid in the past 30 days.

8. Termination

You may cancel your service plan with 10 days’ written notice.
We reserve the right to terminate service at our discretion with written notice (and refund any unused portion, where applicable).

9. Governing Law

These Terms are governed by the laws of the jurisdiction in which Activa operates (Pakistan, unless otherwise stated).

10. Changes to Terms

We reserve the right to update these Terms at any time. Updates will be posted here with a revised effective date. Continued use of our services constitutes acceptance.
